Because of marriage laws and sometimes because of choice, committed couples do not marry. This often leaves them with specific life and estate planning problems that most other law firms are not focused on solving. All of your property can be combined, you can grant each other full authority to act on each other’s behalf for financial and health care matters, and you will have a plan for distributing your estates to each other. If desired, some or all property can be left separate and given to others. It all depends on your wishes. The legal documents include:
- A Revocable Living Trust designed to maximize legal protection of your assets from outsiders while allowing both of you to control your property as you see fit and avoiding probate.
- A Domestic Partnership Property Agreement outlining certain property arrangements to avoid gift tax pitfalls.
- A Last Will and Testament for each of you specifically designed to thwart Will contests.
- A Financial Power of Attorney for each of you allowing the other to act on their behalf in most legal and financial transactions.
- A Health Care Power of Attorney for each of you allowing the other to make health care decisions if one of you is incapacitated.
- A Living Will for each of you directing a doctor to withhold life support and artificial nutrition if you are in a persistent vegetative state or you are terminal and incurable.
